These Terms & Conditions ("Terms") govern your use of the ClearviewPools website and the residential pool cleaning and maintenance services we provide in El Paso, Texas and the surrounding area. By using this website, requesting a quote, or accepting service, you agree to these Terms.
1. Services
ClearviewPools provides residential pool services, which may include weekly cleaning, water testing and chemical balancing, green pool recovery, filter and equipment service, tile and waterline cleaning, and one-time or vacation cleans. The exact scope of your service is what is described in the quote you accept.
We service residential pools only. We are not a licensed construction, plumbing, or electrical contractor, and we do not perform structural pool repair, re-plastering, or electrical work.
2. Quotes and Pricing
- Quotes are based on the pool size, surface, equipment, condition, and photos or information you provide. If conditions on site differ materially from what was described, we will re-quote before performing additional work.
- Weekly plans are quoted as a flat rate that includes labor and standard maintenance chemicals unless your quote says otherwise.
- Work outside the quoted scope — such as green pool recovery, drain and acid wash, filter replacement, parts, or equipment repair — is quoted separately and requires your approval before we begin.
- Prices may change with reasonable advance notice. Any change to your weekly rate will be communicated before it takes effect.
3. Scheduling and Access
- Weekly customers are assigned a fixed service day on a nearby route. Service times within that day may vary.
- You are responsible for providing safe, unobstructed access to the pool and equipment pad on your service day, including unlocking gates and securing pets.
- If our technician cannot access the pool, we may need to skip the visit. Skipped visits due to lack of access are still billable, and we will notify you when this happens.
- Service may be delayed or rescheduled due to severe weather, dust storms, lightning, monsoon conditions, or other circumstances beyond our control. We will make reasonable efforts to catch up the following visit.
4. Equipment, Water and Utilities
- You are responsible for maintaining working pool equipment, adequate water level, and the electricity and water needed for the pool to operate.
- We inspect equipment during routine visits and will flag problems we notice, but we do not guarantee that we will detect every defect or impending failure.
- We are not responsible for pre-existing damage, wear, or failure of pumps, filters, heaters, automation, plaster, tile, or other pool components, or for consequences of equipment you decline to repair after we report an issue.
5. Water Chemistry Results
We balance water using industry-standard practices for local conditions. Because heat, bather load, rainfall, dust, refill water quality, and equipment performance all affect results between visits, we cannot guarantee that water will remain perfectly balanced or clear at all times. If something is off, tell us and we will correct it on the next visit or sooner when practical.
6. Payment
- Weekly service is billed monthly unless your quote states otherwise. One-time and recovery jobs are billed on completion or as agreed in the quote.
- Invoices are due on the date shown on the invoice.
- We may pause service on past-due accounts after notifying you. Service resumes once the balance is paid.
- Card payments are processed by a third-party payment processor; we do not store full card numbers.
7. Cancellation
There is no long-term contract. You may cancel weekly service at any time by calling or texting us. Please give us notice before your next scheduled service day; visits already completed remain payable. We may also discontinue service — for example, if access is repeatedly unavailable, if conditions are unsafe, or for non-payment — with reasonable notice.
8. Safety
Pool chemicals can be hazardous. Keep people and pets out of the pool and away from the equipment pad while we are servicing it and for the period we advise after chemical treatment. Pool safety, supervision of swimmers, and compliance with applicable fencing and barrier requirements remain your responsibility at all times.
9. Limitation of Liability
To the fullest extent permitted by Texas law, ClearviewPools' total liability arising out of or relating to our services is limited to the amount you paid us for the service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of use of the pool. Nothing in these Terms limits liability that cannot be limited by law.
10. Website Content and Intellectual Property
The content on this website, including text, logos, and layout, is owned by ClearviewPools and may not be copied or reused without permission. Photographs on this site may be stock imagery used for illustration. Statistics, review quotes, and service descriptions are provided for general information and do not constitute a guarantee of specific results. This website is provided "as is" without warranties of any kind.
11. Communications
By providing your phone number, you consent to receive service-related calls and text messages from us about quotes, scheduling, service notes, and billing. Message and data rates may apply. You can opt out of texts at any time by replying STOP or telling us directly. See our Privacy Policy for how we handle your information.
12. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Any dispute will be brought in the state or federal courts located in El Paso County, Texas.
13. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with a new "Last updated" date, and continued use of our website or services after an update means you accept the revised Terms.
